Amendments to the duty of care requirements in Section 34 of the Environmental Protection Act (1990), introduced under the Waste (Scotland) Regulations 2012, requires businesses to take all reasonable steps to separate dry recyclables and food waste for collection.
From 1st January 2016 the threshold for businesses to separate food waste will drop from 50kg to 5kg per week. Waste producers failing to separate material correctly are liable to fines of up to £10,000.
